Corinna and all,
I discussed the issue with our site exec and they are also in favor of CC-BY, and we will be implementing that policy in GCE metadata.
I think defaulting to CC-0 with the proposed general statement of expectations is acceptable if no rights are explicitly stated, but only if contributors are made aware of this practice before submitting metadata/data.
However, I would ultimately like to see NSF step in and help us interpret the disparate policy guidance from DEB, OCE and POL. For example, when the allowed embargo period is over, do the original investigators really have any say over how the data are used, or are they public domain? That would certainly be in the spirit of the open science initiatives Federal agencies are expected to operate under. Also in other communities like genetics/genomics there are no rights once data are archived. So this lack of clarity is the reason we keep coming back to these policy discussions and can never put the issue behind us. Considering the broad implications for software development and repositories, I really think this should be nailed down once and for all. Just wishful thinking, though.
Wade

Hi Corinna,
PIE is going to adopt the CC-BY for intellectual rights as it has an attribution feature that expects data users to cite authors of the data.
CC-0 seems appropriate for data in the Data Portal if it has no intellectual rights stated.
A next step would be what the recommended citation should be and what elements from EML should be used to populate the citation in the Data Portal.
As an aside, going forward it will interesting to see how familiar reviewers and editors of journals become with data citations and whether the appropriate data citation has been used. Currently reviewers are mostly familiar with journal article citations and may comment about whether a citation/reference is more or less appropriate for the subject matter at hand. Will there be an increased burden on reviewers and editors to have as much familiarity with data citations and their accuracy and interpretation?
Thanks
Hap

Hi all,
Thanks to those who have commented already, this is just a quick reminder that the deadline is coming up. This will be discussed at the next EB meeting at the end of April.
Thanks

Subject: LTER Data Access Policy Request for Comments
Dear all,
To work through issues that may require some changes to LTER data management practices we would like to employ a process of requesting comments from all of you.
We are starting with the LTER Data Access Policy. Background, reasons for changing it, and recommendations are outlined in the attached document. Please either discuss on this list, send your comments, concerns, questions to IMexec or directly to Corinna cgries at wisc.edu<mailto:cgries at wisc.edu> before April 15th. If there is enough time this discussion will also be part of the agenda for the next Water Cooler.
We will collate all of the comments and formulate recommendations based on those comments to send to the EB before the Science Council meeting in May.
The same request for comments will go out the LTERexec mailing list. Please discuss with your PIs.
Thanks
EDI and NCO
